Welcome, Spring 2015 students!

Welcome to my Media Law blog. I use this blog as a teaching tool that allows me to comment on current events and topics related to media law. It also allows you to participate in discussions involving media law topics.

As the name of the blog suggests, I want you to use this forum to speak freely about the topics that we will discuss in MC 4301 Mass Communication Law & Ethics.

We will discuss some controversial topics -- and often, we may not agree. You may not agree with me, or you may not agree with your classmates.

But this is a forum of expression, so you have the right to express your opinion. My opinion is not correct just because I'm the instructor. You should feel free to disagree with me.

Think about this as the First Amendment in practice.

A few ground rules, please. Some of our discussions may become heated. While you have the right to express your opinion, I urge you to be considerate of others, especially those with whom you disagree. Avoid attacking or belittling someone just because you disagree with his or her opinion. And, I suggest you double check your comment for grammar, clarity and sensitivity before you post.

With your comment, please include your first name and initial of your last name. Also, include your class (TTh, Online or Honors). I need this information to keep track of your comments for participation points.

You can get an idea of how I used this blog in past semesters, though you are not responsible for reading or commenting on previous blog entries.

Now, let's start with something light.

Share with us a favorite book, movie, TV show, song, etc., that is related to law, then tell us why it's your favorite.

I'll go first. In past semesters, the movie I would call my favorite is "Twelve Angry Men" -- the original with Henry Fonda. But in 2012, I saw Steven Spielberg's "Lincoln" and was thoroughly impressed. The movie recounts President Lincoln's effort to encourage Congress to pass the Thirteen Amendment, which abolished slavery. A movie about passing a constitutional amendment? How perfect for a media law prof!

I look forward to reading your comments.

My favorite law-related movie is Michael Clayton. I love how many of the characters were gifted in their knowledge of the law practices they specialized in, such as Arthur. The plot is definitely fictional, but the movie seems realistic to me which I really enjoyed. - Josue P. Honors class.

The most recent movie that resonated with me was Glory. It's a recount of how african americans struggled to assimilate into the all white army at the time of the war. I like to see how the characters struggled with their identity and how they all came together at the end. Of course Denzel was an incentive.

My favorite law related show was JAG. It focused on a lawyer in the Judge Advocate General's Corps. I learned a lot about the military and the laws that surround and help those who served. My grandpa would explain what was happening in each episode, as he was a veteran and familiar with it all.

Oh, Legally Blonde is definitely my favorite law-related movie. Just kidding... I don't necessarily have a favorite fictional/historical law movie, however I am interested in documentaries based on controversial state laws. How to Die in Oregon has been the most touching documentary I've seen thus far.

My favorite law related book is To Kill a Mockingbird. It's such a classic book about a white lawyer defending a black man who is accused of raping a white woman. I feel like the author does a good job of showing what life was like back in those days.

One of my favorite movies related to law is the Lincoln Lawyer with Matthew McConaughey. It is fresh on my memory because I just recently watched it again. I like this movie because it shows that not everything in law is as it appears. Although something may look like a clear and easy trial, it is not always the case. One of my favorite scenes in the movie is when Matthew McConaughey (Mickey) explains that a defense lawyer's job is to make the prosecutor prove that the defendant is guilty because it shows that he doesn't believe the defendants are innocent, he just wants to make sure the law is fair and just. This movie is great if you like unexpected endings.

The best law related show I've seen, I saw last summer. I watched House of Cards, a Netflix series. It's set in Washington, and shows politician Frank Underwood's rise in political status. It's really intense, and he will do anything to get his way.

My favorite law movie of all time would be "A Time to Kill" starring Matthew McConaughey, Samuel L. Jackson and Sandra Bullock. The movie shows the obstacles and hardships a white male lawyer faces, in Canton, Mississippi, while trying to defend his black client that killed the two white men responsible for raping his 10-year-old daughter. The movie reminds me of the race and injustice issues that was present within the justice system.

One of my favorite movies of all time is Remember the Titans. Although not specifically focused on the law the entire movie plays off of the after effects of allowing both black and white kids to be in the same schools. The movie portrays the struggle everyone goes through in finding acceptance, and the trouble that remains when introduced to new things.

My favorite movie/book/tv show that would have to do with law is probably Parks & Rec. A little more light-hearted than some of the other examples mentioned, but still has to do with the law (a lot of the time), and yet is hilarious at the same time.

Crystal W. (honors) said...

I remember watching Twelve Angry Men in a polisci course in high school and absolutely loving it. The movie emphasizes that people and situations aren't always as they appear.
And I have to agree with Darion, Parks & Rec. is an amazing show! While it may be light, I sometimes catch some more serious undertones within the show.
As for my favorite show that has to relate to law, currently I would have to say Dexter. Although it does not directly relate to law per se, I enjoy it not only for the story line, but because it shows how easily one can manipulate the system especially if they are perceived to be "normal" or are well-liked. Many times ethics are compromised. This is something that I believe happens very often in government: abandoning ethics and manipulation.

My favorite law related entertainment item would have to be the Dixie Chicks documentary film "Shut Up And Sing." The documentary shows the Dixie Chicks in the aftermath of an anti-Bush statement at one of their concerts. It exposes the First Amendment -- freedom of speech and the right to peaceably assemble. Freedom of speech when Dixie Chicks lead singer Natalie Maines made the anti-Bush statement and the right to peaceably assemble when Bush supporters would gather to protest against the Dixie Chicks being played on the radio.

My favorite law-related movie would have to be "The Rainmaker," based on the John Grisham book of the same name. Matt Damon plays Rudy Baylor, a scrappy underdog of an attorney who represents a man dying of leukemia. The man would be fine if he had gotten a bone marrow transplant, but the operation was denied by his insurance company. The film is great because it shows how the powerless can use the law as a sort of equalizer, since Rudy eventually wins his case after an arduous legal battle.

I recently went to see Selma in theaters with a friend of mine and it was such an impactful experience for us both. It depicts the 1965 Selma to Montgomery voting rights marches led by James Bevel, Hosea Williams, and Martin Luther King, Jr., in addition to many other influential activists. MLK Jr. recognized that black citizens were actively being denied the right to vote, and he sought legislation from the Johnson administration to guarantee the ability of black citizens to register to vote unencumbered. Eventually, Johnson signed the Voting Rights Act of 1965, but it took a long period of time filled with death and violence before the act was passed. This movie, and others like it, will always be relevant because white supremacist systems of oppression are still very much at play today. It was an especially profound film given the recent events in Ferguson and the continued killing of unarmed black folks across the nation.

I would have to say my favorite law-related film is "The American President" directed by Rob Reiner and written by Aaron Sorkin. I will have to agree with Justus on the previous comment about the show House Of Cards. It is one of the greatest shows I have watched on Netflix. Frank Underwood (Kevin Spacey) is a twisted congressman to say the least.. throughout the show he will look at the camera and talk to you as if you are there with him. This keeps you engaged in him and the show throughout both seasons. BTW the third season comes out February 27.

One of my favorite law related movies has to be Law Abiding Citizen. This film with Gerard Butler and Jamie Foxx is an incredible action movie about a man whose wife and daughter are the victims of rape and then killed while the murderers get away with the crime. Although this is a completely different spin on the law and government that we have today. I recently just saw and read the book Divergent. I was highly impressed with both and fell in love with the series. In this series there is a different kind of government, nothing like how ours is today. One can say it is more of a dictatorship. After so many years of war in their city, humanity has reached a time where the only way to survive is by creating a new democracy by splitting into five factions. Once you turn sixteen you can choose from any of the factions. The Erudite is the one that is in complete government control of the entire city. Its not until they start trying to take over does someone do something about it, which of course starts another war.Later in the series even more unlawful government conspiracies arouse .If anyone has not read this book series I highly recommend them!

I recently saw the movie "Selma". It was about the movement made by MLK in the 1960's. It did a great job showing tho bravery and courage it took to end segregation. It is perfect to discuss in this class because it showed the push MLK and followers had to make against the government for equal voting rights.

This really resonated with me because it showed me the sacrifices made by others to better the future. Not only did it change my life but it also changed many others. It even made it possible to have our first african-american president!

My favorite law related show right now is The Blacklist, which is a Netflix Original Series. It's all about the FBI, criminals and cases needing to be solved. In my opinion, the best part about this show is it's main character, Reddington. His character is a sarcastic, rude criminal who helps the FBI capture other blacklisters such as himself. He's probably the reason I enjoy so the show so much because he's such a jerk but at the same time he's what makes the entire show interesting.

Even though it scares me every time I watch it, I’m a fan of the movie the Exorcism of Emily Rose. The movie narrates through a court trial while depicting the stories of the witnesses. Due to the nature of the case the court found it hard to stay logical while analyzing the supernatural details. It would be interesting to see how our current court system actually dealt with a case of that nature.

The first law-related media that comes to mind for me is Serial, the podcast. I'm two episodes from the end of the podcast. Serial is an incredibly famous podcast in which the narrator conducts an investigation of sorts about a murder trial that happened in the '90s. The whole point of the podcast, it seems, is to figure out whether Adnan Syad, who has been in jail for the crime since 1999, actually committed the crime. Serial deals with law in that it deals with America's justice system, but it also deals with media law in that it's been met with lots of controversy about whether Serial's style of journalism is ethical. The narrator often adds her own bias into the podcast and considers herself Adnan Syad's friend, which could possibly further her bias about the crime. Critics also have trouble with the fact that the narrator has no background with the justice system and therefore shouldn't be reporting so thoroughly on such a subject.

My son and I went to go see Selma last week, and I'd have to say it's one of my favorite movies that's related to law. One of the scenes, which was striking was Oprah's character attempting to register to vote. She had absolutely no power, and her ability to register was left up to one man's decision to view her as an equal and human. In his eyes she was neither. He hurled various questions at her that most today could not answer. All in all, the movie was a reminder to me and a lesson for my son that justice and equality is never given. One must fight for it.

The story follows Spacey's character Frank Underwood's rise to political power from House majority Whip to Vice President through his manipulation of the media and blackmail. A book that I read in high school related to law is "To Kill a Mockingbird." I loved this book because it was a story in which racism and segregation in the south was fought against. A father named Atticus Finch is an attorney who decides to defend an innocent black man named Tom Robinson. Tom is falsely accused of rape and many people during that time period did not believe he was not guilty. Atticus believes in justice and wants to prove that although Tom is a black man, that does not make him guilty of rape. In no particular order I like:

Runaway Jury - Suspenseful movie that focuses on the little known business and science behind jury selection and the effect it can have on trials.

Amistad - I liked how it showed the twisted law of the early colonial times. It features Anthony Hopkins in a great role as John Quincy Adams. The movie shows the legal proceedings that fought the idea of Africans as legal properties. Very emotional movie.

The Siege - A thriller featuring Denzel Washington and Bruce Willis. The film shows how the US could become a military state after terrorist bombings. The stupid decisions people make due to emotions and fear in the movie lead things from bad to worse.

The Firm - Shows the possible/probable darker side of some firms. I think one of Tom Cruise's better films. In the end law firms are all about the business.

Notable mention to: A Few Good Men, The Devil's Advocate, and A Time to Kill.

I recently had the privilege of seeing the film Selma, and was blown away by the portrayal of a horrifying America that existed just 50 years ago. It was hard to watch the protesters run for their lives as the police officers charged against them on horses with guns and batons waving in their hands. It was hard seeing how difficult it was for African Americans to gain the most simplest of rights-such as voting or voicing their opinions. My favorite movie is Legally blonde if we are talking about a comedy about law. However, if we are talking about something more serious... I would have to say that I really like the TV show named Law and Order Special Victims Unit. I know it sounds ironic because it even has the word law in the title. However, I have been watching this show for years now and have learned so much about how the the courts and the judicial system works. Also, I have learned big terms that I would have not heard if it wasn't for the show (plus the directors make it so interesting and real).
This TV show has also taught me some civil protections and liberties that citizens here in the United State have which are similar to some of the amendments we talked about on Thursday (like the 1st and 2nd and a lot more).

I do not watch many movies outside of comedy usually, so one of my favorite "Law-related" movies I would say is "The Other Guys" with Will Ferrel and Mark Wahlberg. Two of my favorite actors who made me enjoy the movie the most. The law related aspect I believe can come from the main characters being detectives with law enforcement and fighting crime in a hilarious manner.

Another favorite of mine from a law perspective is a hip-hop music duo by the name of Run The Jewelz. They're music is quite different for the typical hip hop listener but there political views inside and outside of music is very interesting as they do voice they're perspective on laws and justice of certain law aspects.

I do not read, even though I should and the only TV i really watch is ESPN because I don't believe in the news on television because it is mainly aired for fear factor these days and not to actual inform people primarily.

That is just my personal opinion.

I love anything related to the Law and Order franchise but I think SVU has been the most intense, at times some of the crimes have even made me feel sick but I enjoy the show because I have an interest in law and it's fun to see some of the terminology used in my criminal justice classes in real situations. I've also learned a lot more. Also, I think that it's notable to mention that SVU gives you a look at how the victims lives are physically and mentally affected by the crimes committed against them, something we may not have been exposed to unless it happened to us or someone close to us.

Honestly, I have not read a good book regarding law in a while. BUT, I do watch and really enjoy crime shows like law and order and especially forensic files. I feel that forensic files relates somewhat to what we will talk about in the class. The reason i love to watch these shows it because i actually like hearing about these horrific things people do and the process t takes to find these people. Then i like to see all the evidence presented in court and hear the rulings!

Lincoln and Twelve Angry Men are both fantastic movies! Daniel Day-Lewis gave a suburb portrayal as Lincoln. My favorite Government (law) inspired TV show right now, with our a doubt, has to be House of Cards with Kevin Spacey. I know that it plays on fictional characters that are involved in seriously scandalous situations, but I love how realistically-or what I perceive to be realistic-the show portrays the inner working of politics in Washington DC. I would imagine that the egos, deception, personal agendas, and politics are crafted after real life experiences by the writers/creators. I'm highly looking forward to Season 3 which comes our next month.

I saw the movie 'Selma' last Friday and walked out of the theater speechless. The movie was about the voting rights marches Martin Luther King Jr. organized in the 1960s. Blacks were being denied their constitutional right to vote by bigoted policies and intimidation by white citizens. Without the right to vote, the black population in the South had no voice. The Voting Rights Act was passed in 1965 after a tremendous amount of bravery and perseverance was expended by activists from all over the country. This movie reminds us that we have come a long way, even though there is still progress to be made.

My favorite law-related movie is Devil's Advocate! I love the overall theme and the display of typical American values such as: ambition, drive, and materialism. I also enjoy how it shows the vanity that a lawyer will succumb to when he consistently wins and wants to continue to win. It also shows to me how giving into sins such as vanity can cost you everything if not careful. Not only that but it's a SIIIICKKK film; I mean, it's got Al Pacino... come on.

My favorite book of all time is David Baldacci's Wish You Well. It is an amazing book about a family who is in a tragic car accident the father dies and the mother is left in a coma. The two children are forced to live with there grandma they barely know on the side of a mountain in a rural town of Kentucky. The book is a huge story and there is a big court room scene with a small town lawyer that used to be in love with the childrens mother. It has been years since I have read it but I love it.

I'm sure you're all familiar with it, but my absolute, favorite television show (having to do with law) hands down, would be Law and Order SVU!! Elliot and Olivia give me life! I watch it with friends morning, noon and night. Weekends, holidays, you name it, we're watching it. This is probably the best example of anything pertaining to law because there are so many different situations, events and outcomes within the show.

Although, everytime I watch it I think I'll figure out 'who done it' but I'm still surprised, as there's always a twist. Dick Wolf has a creative mind and Im glad he decided to share it with the world.

My favorite law related movie is Amistad. Its a little older, I think 1997, but it's about a boat of slaves that were being illegally traded from Cuba. They were ripped from their homes in Africa and the boat accidentally crashed in America. The case was to decide whether they were considered free and had a right to go home, belonged to the Cubans, or if they were American property. It's such a stunning movie that gives real insight to how deluded the system can be and also has a lot of life lessons as well.

I'd recommend watching Mr. Smith Smith Goes to Washington. The film is about Senator Jefferson Smith, a young naive newcomer, who goes to Washington and ends up being taken under the wing of a corrupt senator. It's a great film because it tackles the issue of corruption in politics, which was a big issue during the 1930's when they filmed it. The film is over 75 years old, and it's crazy how the movie can relate to today. House of Cards is a perfect example of what people think of today's political system. We'd all like to think that the government is working within their legal statues, but we all know that isn't always true.

Also, the fact this movie is based off real life events makes it much more fascinating.

Though this isn't as heavy as some of the inspiring biopics others have chosen, I really enjoy watching "Suits" on USA. It follows a group of lawyers, one of which is a fraud, and the friction between one another as well as other firms and clients. Perhaps this is more dramatized than what it is like at real firms, but I feel the writers have great wit, the characters are riveting and it's not uncommon for the show to suddenly flip just when you think a case is settled. I've started watching "Penn ad Teller" they're two magicians who discuss issues happening in the world today. The most recent episode was about the criminal justice system and how prosecutors are pressured to "catch the criminal," or at least catch someone to please the public. They then talked about how one innocent person behind bars equals at least one free criminal. They also discuss gun control and politics. They may not be the most credible of sources but they definitely have a way to get you thinking about our freedoms and what is costs others.

So far, one of my favorite law related books is The Mystery of Lawlessness by Alberto Ramon. I was introduced to this book by my Chicano Literature professor two years ago.
